Quelques jours apr\u00e8s la condamnation d’Ousmane Gnelloy \u00e0 deux ans d’enprisonnement , par la justice guin\u00e9enne dans l’affaire qui l’opposait \u00e0 Dame Kadiatou Biro Diallo, Bamsamba Amine Barry juriste politologue et pr\u00e9sident du MODEN dit ne pas \u00eatre d’accord de la d\u00e9cision de la justice, selon une publication qu’il a faite sur les r\u00e9seaux sociaux. M\u00eame si certains se r\u00e9jouissent du verdict rendu.<\/strong><\/p>\n

<<Je ne pouvais plus dormir sans dire ce que je pense de cette histoire. Dieu est v\u00e9rit\u00e9 !\u261d\ufe0f<\/p>\n

On va toujours dire la v\u00e9rit\u00e9 \u00e0 Fatou Gnelloy et son fr\u00e8re Ousmane Gnelloy. Mais il est important qu’on se dise aussi la v\u00e9rit\u00e9 entre nous.<\/p>\n

\ud83d\udd34 Avant tout, il est fondamental de pr\u00e9ciser, tout de suite, deux choses:<\/p>\n

1- Je ne commente pas de d\u00e9cisions de justice, mais j’ai le droit de ne pas pouvoir comprendre et de demander \u00e0 comprendre, quand c’est loin, tr\u00e8s loin, d’\u00eatre facile \u00e0 comprendre.<\/p>\n

2- Ousmane Gnelloy n’est pas jug\u00e9 pour tous les cas d’injures publiques dont s’est rendu coupable, mais uniquement pour le cas de notre v\u00e9n\u00e9r\u00e9 p\u00e8re ancien Pr\u00e9sident de l’Assembl\u00e9e Nationale Alhadj Boubacar Boris Diallo dont le dossier est port\u00e9 par sa fille biologique Dame Kadiatou Diallo. Donc, c’est uniquement de ce cas l\u00e0 qu’il s’agit ici.<\/p>\n

\ud83d\udc49 Le mobile importe peu, tr\u00e8s peu, on dit en droit p\u00e9nal.
\nJ’insulte tes parents publiquement, ce n’est pas bien. L’injure publique est un d\u00e9lit, on est tous d’accord.<\/p>\n

\ud83d\udc49 En r\u00e9action, au lieu d’aller directement porter plainte contre moi, tu d\u00e9cides de te rendre justice, tu me frappes, tu me blesses. C’est toi qui iras en prison et le juge s’en fiche de savoir qui a commenc\u00e9. C’est cela le droit.<\/p>\n

\ud83d\udc49 Mais quand on a un avocat pas tr\u00e8s fort, on peut avoir raison et perdre le proc\u00e8s pour se retrouver m\u00eame en prison. Ce n’est pas un d\u00e9bat. Tout r\u00e9side dans la d\u00e9fense et dans la mani\u00e8re de d\u00e9fendre, d’exposer les faits et sauver le client. \u00catre avocat demande un grand art.<\/p>\n

\ud83d\udd34 Sinon, c’est tr\u00e8s simple \u00e7a: ton p\u00e8re est victime d’injures publiques, tu te rends justice et de mani\u00e8re totalement disproportionn\u00e9e en faisant couler mon sang, tu deviens le bourreau et l’insulteur d\u00e9vient la victime.<\/p>\n

\ud83d\udd34 Il est d’un principe de droit universel et \u00e9ternel que nul n’a le droit de se rendre justice.<\/p>\n

\ud83d\udc49 En conclusion, cette condamnation tr\u00e8s g\u00eanante me donne une impression que j’ai du mal \u00e0 accepter : \u00e0 savoir que Ousmane Gnelloy a \u00e9t\u00e9 jug\u00e9 pour un seul cas, mais il a \u00e9t\u00e9 condamn\u00e9 pour tous les autres cas non port\u00e9s pourtant devant le juge. Les \u00e9motions et les passions n’ont pas leurs places dans les cours et tribunaux. Mieux vaut relaxer un coupable que de condamner un innocent. Faisons tr\u00e8s attention !<\/p>\n

NB: Si vous n’\u00eates pas juriste bien cal\u00e9 et que vous n’\u00eates pas d’accord avec ce que je dis, pri\u00e8re de passer votre chemin.<\/p>\n

Et je lance un d\u00e9fi un n’importe quel juriste qui veuille m’en prouver le contraire, on aura un d\u00e9bat film\u00e9 Claire et net. Point barre!<\/p>\n
